2. Acceptance and capacity
Accessing and using this website means you accept these Terms of Service. If you do not agree, do not use the site.
You must be at least 18 years old and have legal capacity to accept these terms. The site is intended for adults and is primarily directed at users in Europe.
3. Description of the service
This is IDLING’s marketing website. It provides information about the project and a waitlist form to join the waitlist and, where applicable, receive invitations to pre-launch trials (e.g. in Málaga and other cities).
These terms do not govern use of the IDLING app when available; separate terms will apply then.
4. Waitlist
By joining the waitlist:
- You ask to be informed about IDLING’s development and launch; you acquire no contractual right to access, an account, beta access, or launch in any specific date or city.
- You must provide accurate data. We may refuse, cancel, or remove fraudulent or duplicate registrations.
- By submitting the waitlist form, you request to be registered and acknowledge that we may send you service emails about your registration (confirmation and notice when IDLING is available in your area), as described in our Privacy Policy. Marketing emails (tips, news, offers) are sent only if you opt in via the optional checkbox.
5. Communications
Service emails (waitlist confirmation and launch/availability notice) are sent in connection with your registration as described in the Privacy Policy.
Marketing emails are sent only if you have opted in. You may withdraw marketing consent or unsubscribe from marketing messages at any time via the link in those emails or by writing to hello@idlingapp.com.
Unsubscribing from marketing does not automatically remove you from the waitlist; to stop all emails including service messages, contact us or exercise your rights under the Privacy Policy.
6. Cookies and privacy
Personal data processing is governed by our Privacy Policy. Cookies and similar technologies are described in our Cookie Policy.
7. Intellectual property
Site content (text, design, logos, marks, images, and software) belongs to the operator or licensors. Unauthorised reproduction or use is prohibited.
8. Permitted use and prohibited conduct
You must not use the site unlawfully, submit false data, introduce malware, perform unauthorised mass scraping, disrupt the site, or infringe third-party rights.
9. Third-party links
The site may link to social networks or other third-party sites. We do not control or endorse their content; access is at your own risk.
10. Availability and changes
The site is provided “as is”. We may modify, suspend, or withdraw the site or waitlist without prior notice, within legal limits.
11. Disclaimer of warranties
To the extent permitted by law, we do not warrant that site information is complete, accurate, or always available, or that IDLING will launch by any particular time or in any territory.
12. Limitation of liability
To the extent permitted by applicable law, the operator is not liable for indirect loss or loss of profit arising from use of the site or waitlist. Nothing here limits liability that cannot be excluded for consumers under mandatory law (including Spain and EU rules).
13. Consumer users
If you are a consumer, you retain non-waivable rights under the laws of your country of residence and EU rules.
14. Governing law and jurisdiction
These terms are governed by Spanish law. For non-consumers, the parties submit to the courts of Málaga, Spain, unless mandatory law provides otherwise.
Consumers may bring claims in the courts of their domicile where the law allows.
15. Online dispute resolution
The European Commission provides an ODR platform: https://consumer-redress.ec.europa.eu/.
16. Changes to these terms
We may update these terms. The current version will be published on this page. Continued use after material changes may constitute acceptance where the law permits.
17. Assignment and succession
When a company is formed to operate IDLING, it may succeed to the operator’s position under these terms, with reasonable notice to users.
18. Severability
If any clause is invalid, the remainder remains in effect.
19. Language
The Spanish version prevails in case of conflict with courtesy translations.
