Privacy Policy

In compliance with Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR) and Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights (LOPDGDD), we provide the following information:

Purposes of processing

Personal data you submit through the waitlist form are processed to:

1. Manage your waitlist registration (including storing your preferences such as location and intent).
2. Send service emails strictly related to your registration, namely:
   • one email confirming your signup; and
   • one email when IDLING becomes available in your area (or when we invite you to early access where you registered interest).

We will not send you dating tips, newsletters, promotional offers, or other marketing content unless you opt in separately (see below).

Where you join a beta or use the application when available, we may also process your data to manage that participation, including communications about access, operation, and material updates to the service you use.

Marketing (optional): Only if you tick the optional marketing checkbox, we may send commercial communications about IDLING (e.g. dating tips, product news, and special offers). You may withdraw that consent at any time.

We do not use your data for purposes other than those described. We do not create profiles or take automated decisions based on waitlist form data alone.

Legal basis for processing

The legal bases depend on the processing:

• Waitlist registration and related service emails (confirmation and availability/launch notification): legitimate interest (GDPR Art. 6(1)(f)) in operating the waitlist you requested and keeping you informed about access you asked for, balanced against your rights. You may object to this processing (see Your rights).
• Optional marketing emails (tips, news, offers): consent (GDPR Art. 6(1)(a)), given by ticking the optional marketing checkbox. You may withdraw consent at any time without affecting the lawfulness of processing based on consent before withdrawal.
• Beta / in-app participation (where applicable): steps at your request prior to entering into a contract, and/or performance of a contract.
• Legal and tax obligations: compliance with applicable law.
• Analytics cookies (if used): consent, as described in our Cookie Policy.

Where we rely on legitimate interest, we have considered that the emails are limited in number and directly related to your signup, and that you can object or request erasure at any time.

Personal data processed and origin

Depending on how you use the website, we process identifying data, contact data, and browsing data.

Data are provided by you when you contact the Controller, complete the relevant form(s), or use other features offered on the website.

Campaign and traffic measurement on this marketing site (including UTM parameters and referrer, when applicable) is described in our Cookie Policy and runs only if you accept analytics cookies (Amplitude).

Use of contact sections, forms, and other features is voluntary. However, certain fields or features are necessary to handle your request correctly; refusal to provide required information will prevent the Controller from handling your request.

You warrant that data you provide are accurate, complete, and up to date. Data will be erased, deleted, or blocked when inaccurate, incomplete, or no longer necessary for the purpose under applicable law.

If you provide third-party data, you warrant that you have informed them of this Privacy Policy and obtained their authorisation for the purposes stated. You are responsible for any damage arising from breach of this obligation and undertake to keep data accurate and updated.

Links and social media

The website may include links to third-party sites, including social networks where the Controller is present. Those third-party sites have not been reviewed or controlled by this website or its operator, who is not responsible for content users publish there. Remember that your posts may be visible to other users; you are primarily responsible for your privacy on those platforms.

Retention periods

Personal data will be kept for as long as necessary for the purposes for which they were collected, and in particular:

• While a pre-contractual or contractual relationship with you subsists.
• Until you request erasure.
• For periods required by applicable law for legal, tax, and administrative obligations.
• For periods necessary to bring, exercise, or defend claims.
• For beta participation data, while the beta programme lasts.
• In the absence of interaction, data may be deleted after a maximum of 12 months.
• Waitlist service relationship: while you remain on the waitlist and for a reasonable period after your last service email or interaction, or until you request erasure or object (see below).
• Marketing consent: until you withdraw consent or unsubscribe from marketing communications (optional marketing checkbox only).
• If you exercise erasure or objection rights, data may be kept blocked for authorities and courts for applicable limitation periods.

Minimum age

This website is intended only for persons aged 18 or over. We do not knowingly collect personal data from anyone under 18. If you believe we have received data from someone under 18, please contact us at hello@idlingapp.com and we will delete it.

Confidentiality and security

The Controller undertakes to adopt technical and organisational measures appropriate to the risk, to ensure security of personal data and prevent accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data.

Personal data will be treated as confidential; the Controller will ensure by legal or contractual obligation that employees, partners, and others with access respect confidentiality.

Recipients and processors

Personal data may be disclosed to third parties only where required by law or necessary to comply with legal obligations binding on the Controller.

Data may also be processed by service providers acting as processors, necessary for the Controller’s activity, including:

• Hosting, cloud infrastructure, and storage providers.
• Database management providers.
• Electronic communications providers.
• Security, optimisation, and content delivery providers.
• Analytics and digital usage measurement providers, where you have consented to optional analytics cookies.

Processors act on the Controller’s instructions under data processing agreements (including contractual clauses under Article 28 GDPR).

Processing takes place within the European Economic Area; no international transfers are carried out.

Your rights

What are your rights when you provide us with data?

You have the right to obtain confirmation as to whether or not personal data concerning you are being processed.

You have the right of access, rectification, erasure where data are no longer necessary, restriction of processing in certain cases, objection in certain cases on grounds relating to your situation, and data portability where legally applicable.

You may exercise applicable rights (access, rectification, objection, erasure, restriction, portability, and not to be subject to solely automated decisions) by written communication with the reference “GDPR Rights” to hello@idlingapp.com.

You may lodge a complaint with the Spanish Data Protection Agency (AEPD), the supervisory authority in Spain: www.aepd.es.

Where processing is based on legitimate interest (waitlist service emails), you have the right to object on grounds relating to your particular situation. Where you object, we will stop sending those emails unless we demonstrate compelling legitimate grounds that override your interests.

Where processing is based on consent (marketing emails), you may withdraw consent at any time via the unsubscribe link in marketing messages or by contacting us.
